The Financial Professional’s Role In the Collaborative Process

The role of the Financial Professional in the Collaborative Process is to act as a financial neutral and to provide both spouses with knowledgeable and unbiased financial information specific to their situation.  Since all information is fully disclosed in the Collaborative Process, the involvement of a Financial Professional provides both spouses, and their attorneys, with the ability to make informed decisions about the division of their finances.  This includes understanding the nature of their assets and liabilities, any possible tax consequences and the overall impact on their post divorce finances. 

The Collaborative Process and the Financial Professional’s involvement allows both spouses to understand and control the separation of their finances.  The   ultimate goal of this process is to provide both spouses with the satisfaction that they each achieved their best possible financial outcome.

The Financial Professional does not recommend “financial solutions”.  Instead, the Financial Professional assists the divorcing couple in the following ways:

  • Gathers data from each spouse related to their current and post-divorce financial needs, goals and concerns.
  • Provides general financial education, if needed, so that both spouses can make informed decisions and choices.
  • Helps both parties determine their income and expenses based on their post-divorce realities.  This analysis will allow both parties to better determine their post-divorce lifestyle and financial expectations. 
  • Offers financial options based on individual goals and concerns with respect to their division of assets, liabilities and post-divorce support.

Summary
The involvement of a Financial Professional in the Collaborative Process ensures that all financial issues are clearly understood by all parties before any binding decisions are made.  By acting as a financial neutral and providing unbiased options, the Financial Professional provides the knowledge, support and information necessary for both spouses to control and achieve their best possible financial result.
